Hit & Run No Longer Prosecuted. I was stopped in rush hour traffic on the 90 East waiting in line with 100 cars to exit onto the 405 South. I had been stopped for 8-10 minutes and out of nowhere, I was rear-ended by a 1978 black Chevy Pickup Truck traveling at 50 mph. He did not brake. I went into shock and everything went into slow motion. As I stumbled out of the driver’s side door, I instinctively turned on my cellphone video. I looked back at the truck and the driver changed lanes and took off. CHP responded to my 911 call within 5 minutes, along with fire and paramedics. I showed the video to CHP and they told me I had captured the vehicle’s license plate in two frames. The officer guessed the correct numbers and put out an APB for the truck. Another CHP officer spotted the truck in traffic a mile from the crash scene and gave him a sobriety test that he passed. CHP, however, did not arrest him for hit & run. Apparently, according to my lawyer, the DA is no longer prosecuting for H&R because it’s a low-priority crime compared to the other crimes. Therefore, some drivers are inclined to run when there are no longer any consequences. Turns out the guy had insurance after all. My lawyer said although there won’t be any criminal charge, the driver will never be able to get insurance again in CA. At first, I thought it was a good outcome until I thought about it and realized that would likely just put an uninsured driver on the road, thus harming everyone else at risk of an accident with this guy in the future. My car was totaled and the rear turned into an accordion, as did the front of the truck. I have reported this information to the police. Description of the person involved – Hair: Black, Age: 21-35, Build: Medium, Sex: Male, Other details: Lacerations to forehead and face.
